Definitions

For the purposes of these Terms and Conditions:

• Application means the TerraAurelium mobile application, website, and any related software, tools, and services provided by the Company.
• Company (referred to as either "the Company", "We", "Us" or "Our" in these Terms) refers to TerraAurelium.
• Service means TerraAurelium and all related features, functionality, content, subscriptions, updates, and services that help users manage beekeeping operations, hive records, apiary activity, logs, notes, images, and related farm or production data.
• User Content means any content that You create, upload, submit, store, post, transmit, or otherwise make available through the Service, including but not limited to text, notes, records, hive data, inspection logs, images, comments, profile details, and other materials.
• Subscription means any paid plan, recurring plan, premium access, or other paid feature made available through TerraAurelium.
• You means the individual or legal entity accessing or using the Service.

These Terms govern Your use of TerraAurelium. By accessing or using the Service, creating an account, uploading content, or subscribing to a paid plan, You agree to be bound by these Terms. If You do not agree, You must not use the Service.

To use certain features of TerraAurelium, You may be required to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for safeguarding Your login credentials and for all activity that occurs under Your account. You must notify Us promptly if You suspect unauthorized access to Your account.

We may suspend, restrict, or terminate accounts at Our sole discretion if We believe a user has violated these Terms, created risk for the Service, infringed any rights, or misused TerraAurelium.

TerraAurelium may allow You to create, upload, store, and manage content, including text entries, hive logs, inspection notes, operational records, and images.

You retain ownership of the User Content that You create and upload. However, You are solely responsible for Your User Content and for ensuring that it is lawful, accurate, and does not infringe the rights of any third party.

By submitting or uploading User Content through TerraAurelium, You grant the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, modify, display, and use that User Content solely as needed to operate, maintain, secure, improve, support, and provide the Service.

We may remove, restrict, review, or refuse User Content if We believe it violates these Terms, applicable law, the rights of others, or the integrity and safety of the Service.

TerraAurelium may offer free and paid Subscription plans. Certain features may only be accessible through a paid Subscription.

By purchasing a Subscription, You agree to pay all applicable fees, charges, and taxes associated with the selected plan.

Subscriptions may renew automatically unless canceled before the renewal date, subject to the terms presented at the time of purchase or the rules of the applicable app store or payment provider.

If Your Subscription is purchased through Apple App Store, Google Play, or another third-party platform, billing, cancellations, renewals, and refunds may be governed by that third party's policies.

We reserve the right to change pricing, features, plan structures, or subscription benefits at any time. Any such changes will take effect in accordance with applicable law and the notice We choose to provide.

We may suspend or revoke access to paid features if payment fails, is reversed, or is disputed.

TerraAurelium, including the Application, Service, software, code, interface design, structure, layout, visual elements, databases, features, branding, names, logos, graphics, written materials, and all other content provided by the Company other than User Content, is and shall remain the exclusive property of the Company and its licensors.

All TerraAurelium trademarks, service marks, logos, trade names, brand elements, and related branding are the exclusive property of the Company or its licensors. Nothing in these Terms gives You any right to use any of Our trademarks, branding, or other intellectual property without Our prior written permission.

You may not copy, reproduce, distribute, modify, reverse engineer, republish, sell, license, exploit, or create derivative works from any part of TerraAurelium except as expressly permitted by these Terms or by applicable law.

If You provide TerraAurelium with feedback, ideas, suggestions, recommendations, feature requests, or other comments regarding the Service ("Feedback"), You agree that We may use, copy, modify, adapt, publish, commercialize, and otherwise exploit that Feedback for any purpose without restriction and without any compensation, royalty, payment, acknowledgment, or credit to You.

To the extent permitted by law, You irrevocably assign to Us all rights, title, and interest in and to such Feedback.

You agree not to use TerraAurelium to:

• violate any applicable law or regulation;
• upload false, misleading, unlawful, harmful, infringing, or abusive content;
• interfere with the security, stability, or performance of the Service;
• attempt unauthorized access to accounts, systems, or data;
• copy, scrape, reverse engineer, or exploit the Service beyond its intended use; or
• misuse TerraAurelium in a way that could harm the Company, other users, or the reputation of the Service.
